What the rule requires

Justice Dawson’s IDV Part rules require any attorney or pro se litigant who uses AI to prepare a document submitted for filing that involves substantive legal research and writing (legal memoranda, summations, and similar documents) to submit an affirmation at the end of the document. The affirmation must (1) state that AI was used in the preparation, and (2) affirm that the legal research and writing was reviewed and verified for accuracy prior to submission.

The scope is notably broader than most chambers rules: the text says “If AI is used” with “such as ChatGPT” given as an example, sweeping any AI-assisted drafting (including non-generative tools). Most other chambers rules limit themselves to generative AI specifically.

Practitioner workflow

Manhattan IDV Part filings that include legal memoranda or summations should incorporate an end-of-document affirmation.
