What the practices require
Section 7 of Judge Nelson S. Román’s Individual Practices in Civil Cases (S.D.N.Y., rev. Aug. 24, 2026) sets a “Policy on the Use of Artificial Intelligence (‘AI’).” Any party using an AI tool to draft a document submitted to the Court “must inform the Court of its use and identify which portion of the document was created or generated with the use of the AI tool.”
The section expects every attorney or party using an AI tool to understand its capabilities and limitations, and warns that AI tools “may and have on occasion generated fabricated information, fictitious citations and authority.” It strongly encourages, but does not require, review of AI-generated information to ensure it is “proper, legally supported and sound, and based on relevant law(s).” It prescribes no form of disclosure and states no consequence of its own.
Quotable language
“Any party utilizing an AI tool in drafting a document which is to be submitted to the Court must inform the Court of its use and identify which portion of the document was created or generated with the use of the AI tool.”
