What the clause requires

Senior Judge Henry E. Hudson attaches a standard “Pretrial Schedule A (Judge Hudson)” to his scheduling orders; it “shall govern the schedule of events in this action.” Section I.C, “Use of Artificial Intelligence,” reads:

“Should any party utilize artificial intelligence for the preparation of any filing, they must identify the use of the artificial intelligence in the filing and provide a certification that they have reviewed all citations for accuracy.”

The same text appears in the Schedule A attached in Napky, No. 3:24-cv-180, ECF 18-1 (E.D. Va. filed July 3, 2024) and LaCivita v. The Daily Beast Co., No. 3:25-cv-227, ECF 29-1 (E.D. Va. filed Oct. 8, 2025), both footed “Revised 12/1/2023.”

Scope

The clause reaches AI used “for the preparation of any filing” and requires two things only when AI is used: identification in the filing and a certification of citation review. It governs civil cases before Judge Hudson in which the Schedule A is entered.
