What the rule requires
The District of Wyoming’s Local Criminal Rules, in the revision dated August 1, 2026, add Rule 49.1(d), “Use of Artificial Intelligence.” Counsel or a party to a criminal proceeding who uses AI technology “is cautioned that certain technologies may produce factual or legally inaccurate content,” “continues to be bound by the requirements of Federal Rule of Civil Procedure 11, and all other applicable standards and must review and verify any computer generated content to ensure that it complies with all such standards.”
The rule requires no disclosure or certification. It adds an express review-and-verify duty for criminal filings to the district’s General Order 25-01 (May 2025), which reminds all litigants of their Rule 11 obligations when using AI.
